How can you start a business in Slovakia if you are a foreigner.
What does a foreigner need to start a business?
An alien from a third country can be in one of three categories and has different obligations to obtain a trade license accordingly. If you are:
Third-country national with permanent residence in Slovakia - you just need to obtain a trade license. Read the procedure below.
Third-country national without permanent residence in Slovakia - you must appoint a responsible representative, you must obtain a trade license, you must obtain permanent or temporary residence in Slovakia and you must also register in the Commercial Register (registration in the Commercial Register is not required if you have a permanent residence in EU / OECD).
How to proceed?
If you want to start a business, you must register your trade with the Trade Licensing Office, which is in your place of permanent residence, and if you do not have a permanent residence, in your place of business. When processing a trade, it is necessary to proceed as follows:
Fill in the form "FO trade registration" - it can also be found on the website of the Migration Information Center http://mic.iom.sk/
Demonstrate your competence - in the case of craft or related trades, it is necessary to prove professional competence, for example with an apprenticeship certificate, diploma, license and the like.
Prove integrity - by an extract from the criminal record issued in the home Member State or in the Member State of origin of the natural person. If the natural person's home country does not issue such a document, integrity must be proved by an equivalent document. If these documents are not issued within two months of the application, the natural person will provide a sworn statement.
Submission of the appointment, consent and declaration of the responsible representative - if you do not have a temporary or permanent residence in Slovakia or do not meet the special conditions for the operation of the trade, you must appoint a responsible representative. If you have appointed a responsible representative because you did not have a temporary or permanent residence in Slovakia, you can cancel the responsible representative after obtaining it.
The responsible representative must be employed by you and you must pay him at least the minimum wage. They must also have a temporary or permanent residence in Slovakia and must meet the conditions for running a trade.
Submission of authorization to use the property for business - by letter of ownership or lease agreement (it must be stated in the contract that the premises can be used for business). It may also be the consent of the property owner.
Pay the court administration fee.
All documents you submit must not be older than three months and you must also have them translated into the state language. The translation must be officially certified.
When can you start a business?
You can start a business:
If you are a third-country national with permanent residence in Slovakia - the day of registration of the trade or a later day specified in the registration.
If you are a third-country national with a temporary stay in Slovakia - the day of registration of the trade or a later day specified in the notification.
If you are a third-country national without a stay in Slovakia - the day you obtained your stay in Slovakia.
